Privacy policy for the survey
This policy explains who processes the details you provide in the health and fitness survey, for what purpose, and what rights you have. It is based on the Swiss Federal Act on Data Protection (FADP).
1. Controller
The person responsible for processing your details is the person who sent you the link to this survey:
Marco Burger
This person is your contact for all questions about data protection and for exercising your rights under section 7.
2. Platform operator
The survey runs on the platform «Gsund & Vital - Manager», operated by Marco Burger, Oberwilerstrasse 47, 4102 Binningen, Schweiz.
The operator processes your details solely on behalf of and as instructed by the person named in section 1 (processing on behalf of the controller under Art. 9 FADP). The operator does not use them for its own purposes.
3. What data is processed
- Your answers to the questions about health, nutrition, exercise and well-being.
- Your name (required).
- Email address, phone number and age, if you provide them — these fields are optional.
- The time of your submission.
Information about your health is sensitive personal data under Art. 5(c) FADP. It is therefore only processed if you expressly consent before submitting (Art. 6(7) FADP).
4. Purpose of processing
The person named in section 1 evaluates your answers in order to then advise you personally on nutrition, well-being and suitable FitLine products. Your details are not processed for any other purpose. They are not sold and are not used for third-party advertising.
The survey is not a medical diagnosis and does not replace advice from a doctor.
5. Recipients and server location
Your details are received by:
- the person named in section 1 — on the platform and by notification email;
- the platform operator as processor (section 2);
- Infomaniak Network SA, Geneva, which runs the servers and database and sends the notification email.
Other partners on the platform have no access to your submission; the data is technically separated for each account.
Servers, database and backups are located in Switzerland. Your answers and contact details do not leave Switzerland.
When you visit these pages, Google Analytics, a web analytics service provided by Google Ireland Limited, may also be used. Technical usage data such as your IP address, the time and the page visited are sent to Google and may be transferred to the USA. Google bases this transfer on standard contractual clauses.
Only with your consent — and separate from the survey. Analytics is only loaded if you agree in the notice banner; if you decline, no data is sent to Google. This choice is separate from your consent to the survey: you can fill in the survey and decline analytics. Your survey answers are never sent to Google. You can change your choice at any time via at the bottom of the page.
6. Retention
Your submission is stored until the person named in section 1 deletes it. You can request deletion at any time (section 7); it will then be carried out without undue delay.
7. Your rights
- Access — to find out whether and which data about you is processed (Art. 25 FADP).
- Rectification of inaccurate data (Art. 32(1) FADP).
- Erasure or destruction of your data (Art. 32(2) FADP).
- Withdrawal of your consent at any time and without giving reasons. Withdrawal applies to the future; processing carried out before the withdrawal remains lawful.
To do so, simply contact the person named in section 1. You also have the right to contact the Federal Data Protection and Information Commissioner (FDPIC, Bern).
8. Voluntary participation
Taking part in the survey is voluntary. You are under no legal or contractual obligation to take part, and you will not be disadvantaged if you do not.
9. Data security
Data is transmitted in encrypted form (HTTPS). Access to the platform is protected by personal login credentials and can additionally be secured with two-factor authentication (Art. 8 FADP).
This is a translation of the German privacy policy. If the two versions differ, the
